Justice Matters – 12/05/20

Here’s another episode of Glenn Kirschner’s informative vlog on the state of our justice system. While I’m not quite as sanguine about how the system is holding up against the assault of Trump and his Zombpublicans, it is heartening to look at how thoroughly the Trump/Giuliani efforts to overturn the election in the courts have been rebuffed.

The concurring opinion Glenn reads and discusses in this episode is, as he points out, especially powerful because the Judge who wrote it was President of his law school’s Federalist Society chapter and comes from a tradition of conservatism. After reading a little about him, and based on the quality of argument in his dissent Glenn discusses here, I’m of the opinion he is more closely allied with the never-Trump wing of conservatism.

In case you’re interested in the actual opinion, I have embedded the official .pdf file issued by the Wisconsin Supreme Court, which contains Justice Hagedorn’s consenting opinion. I think it’s worth noting this was a 4-3 decision. I find it a bit frightening there were three justices that though this case had merit. We’re nowhere near out of the woods. Then again, in most respects most of us have never actually been out of the woods given the true nature of our nation’s government and history.

Why Stuart Stevens Wants to Defeat Donald Trump | The New Yorker

This is a fascinating interview with one of the players in The Lincoln Project. It is satisfying to hear the words of a conservative, a Republican, who at least respects some of the most basic norms of our government and society. I have no doubt I will have numerous differences with these folks in the future, but I welcome them as useful allies in the effort to deny Trump a second term, which would clearly be disastrous for us and the world. It’s not a quick read (not too long, either) but it’s well worth your while to read.

The longtime Republican strategist discusses his opposition to Donald Trump, his involvement in the Lincoln Project ad campaign, and why he thinks Mitt Romney would have made a great President.

Worst of the Worst!

Never forget that Trump, the spoiled three-year-old rich kid, comes with nothing less than the dregs of society, the worst of the worst; the greedy, unscrupulous, selfish, narrow-minded, bigoted, misogynistic malcontents. And don’t for one moment forget their white supremacy, which masks their white fragility. Trump, and as many Republicans as possible—especially in the Senate—must be soundly defeated come this November.

The only way we’re really going to accomplish what needs to be done is if a substantial percentage of people who normally sit out elections, step up and make their voices heard. Everybody needs to vote in this general election. Everybody . . . or at least a substantial percentage more than has been the case in the last dozen elections. Voter participation hasn’t exceeded 60% since 1968. This is no way to preserve a democratic republic, folks.
