Originalism is Bullshit!

The Founders … Founding.

Amy Coney Barrett considers herself a “Constitutional Originalist.” What, exactly, does that mean? According to Merriam-Webster, it is “a legal philosophy that the words in documents and especially the U.S. Constitution should be interpreted as they were understood at the time they were written.” (https://www.merriam-webster.com/dictionary/originalism)

Think about what that means. If we are to interpret the Constitution based on the realities of the day in the late 18th century, then shouldn’t the only people allowed to vote in national elections be white, property-owning men? What do we make of the 3/5 clause of Article I, Section 2 of the Constitution and how do we reconcile the 14th Amendment (passed in 1868) with the “original” intent of said Article?

In my less than humble opinion, this concept of originalism is as flawed as belief in the Bible being the infallible word of God. Both require one NOT believe in evolution; I don’t here mean biological evolution (which many Bible believers don’t recognize as real) but the natural evolution of society and its economic, political, and general attitudes toward what’s good and just for a people. Our laws, our habits, our customs, our culture, even our morals change over time; sometimes imperceptibly and others rapidly and definitively.

When the Constitution was written, the framers included (Article V) the ability to amend it and, in fact, the first ten amendments—the Bill of Rights—were needed to ensure adoption of the nascent Constitution by some of the States who wanted more guarantees of freedom from unnecessary restrictions on the States and individuals.

Inasmuch as there is a method by which the Constitution can and, in fact, has been amended how can a logical argument be sustained that it must be interpreted in light of the reality of nearly two hundred fifty years ago? This makes absolutely no sense. Two hundred fifty years ago virtually none of the structures, organizations, and technologies we currently enjoy existed. How do we interpret their use and ownership if they weren’t around when the document was written?

Originalism is a sham argument and should be completely ignored. Any jurist taking such a position is, IMLTHO, an intellectually dishonest poseur and should be ignored . . . if not ridiculed. This includes Amy Coney Barrett who, if she had any integrity at all, would not allow this raw power grab and farce of a nomination process to continue.


Lyin’ Lady G

Thirty-nine days until election day, though we all should know by now that this (and many preceding) election(s) is not being conducted or resolved on November 3, 2020. Nowadays we don’t even refer to election day so much as we talk about “election season.”

I am making the argument that, despite how desperately we want to get rid of Donald Trump, it might be even more important to flip the Senate. Without a compliant Senate, if Trump manages to steal this election, he’ll have a far more difficult time getting anything done without the sycophancy of Moscow Mitch and his merry band of bootlickers and toadies.

In that vein, here’s a great video showing the duplicity and hypocrisy of Senator Lindsey Graham. For the record, I don’t give a rat’s ass what Lindsey’s sexual preferences are; I just have a hard time believing he’s not deeply ensconced in the closet. Regardless, I’m quite sure his hypocrisy and cowardice are genuine.

Of course, the best result would be voting in Joe Biden, flipping the Senate, and retaining control over the House. I think we can be reasonably confident the House will remain in Democratic control but, despite the polls, electing Biden and gaining control over the Senate are not foregone conclusions. We need to keep working making these things happen.

Nearly 50 years ago I was preparing for a revolution. It was premature, but I was young and brash. Now I’m an old man and, although I’m in reasonably good shape, old bodies don’t lend themselves readily to battle.

Nevertheless, it’s looking more likely to me a revolution will be necessary to defeat Trump and his bootlickers, toadies, and sycophants. They are all inexorably locked into white supremacy and patriarchy and I don’t see logic doing anything to disabuse them of their hatreds and prejudices.

I think there’s a better than even chance Trump and his minions will find a way to steal the presidency. Should we flip the Senate (hardly guaranteed) and retain the House (all but guaranteed) it’s quite possible Trump can be impeached again—a first for the country—and found guilty this time.

I remain hopeful we can keep from descending into a Balkanized mess of a country but, should the populace rise up, I will do everything in my power to support them for as long as I’m able.

At the same time, should Trump manage to pull off an electoral coup, I’m more than ready to support an effort for California and other states to secede. The country I was born and raised in is already becoming completely unrecognizable to me.

I wish it were otherwise, but here we are.


U.S. or Him?

Yesterday, an article in PoliticusUSA was published under the headline, “Trump Wasted An Entire White House Meeting Trying To Convince His Aides That He’s Mentally Fit.” I’m of the opinion anyone who studies Trump carefully will have no problem seeing this as a predominant feature of his personality. After all, he really is a malignant narcissist, a sociopath, a man with a complete and total lack of humility, humanity, and empathy . . . among other things. I shared the article on Facebook with the following comments:

This serves to highlight the main problem I have (and most of us have) with him as President. How can he serve the interests of the nation when he’s far more interested in how he looks, the optics, than he is on any accomplishment that benefits the American people . . . and I don’t mean corporate America? Kinda reminds me of the concept I’ve held dear since I first became politically active in the sixties: some people are more interested in “being” right, than in “doing” right. These people, who are intent on winning regardless of the cost, need to be avoided.

This also reminds me of something one of my first year law professors said to me. I’m working on a blog post about it and, recently, I hunted him down. His name is Kenneth Cloke and he’s still living and working in Santa Monica, where he’s a mediator and conflicts resolution systems designer. Lately, I’ve tried to articulate the saying and I have yet to convince myself I’m getting it right. There seems to be some nuance missing that I can’t put my finger on, but I’m going to attempt it here.

During a conversation we were having about leftist politics, Ken said “If I had to choose between someone who had the right politics, but was lacking in humanity, and someone who had the wrong politics, but was a humane person, I would choose the latter.” I suppose this is why, despite my being a Marxist, I am always looking for ways to work with people who don’t share my political philosophy. It’s how I’m able to vote as a Democrat. Everything about the Democratic Party, in my estimation, is far more humane than anything about the Republican Party. Also, I think it’s much easier to find compromise with someone who respects your humanity and hard-ass ideologues generally aren’t inhabiting that space.


Worst of the Worst!

Never forget that Trump, the spoiled three-year-old rich kid, comes with nothing less than the dregs of society, the worst of the worst; the greedy, unscrupulous, selfish, narrow-minded, bigoted, misogynistic malcontents. And don’t for one moment forget their white supremacy, which masks their white fragility. Trump, and as many Republicans as possible—especially in the Senate—must be soundly defeated come this November.

The only way we’re really going to accomplish what needs to be done is if a substantial percentage of people who normally sit out elections, step up and make their voices heard. Everybody needs to vote in this general election. Everybody . . . or at least a substantial percentage more than has been the case in the last dozen elections. Voter participation hasn’t exceeded 60% since 1968. This is no way to preserve a democratic republic, folks.


Masks Are For Cowards!

It really blows my mind that people think wearing a mask in order to protect others, as well as yourself, is somehow an indication of weakness. Is it weak for soldiers to wear helmets or gas masks when necessary? Do we make fun of Law Enforcement Officers who wear bullet-proof vests? How about nurses wearing masks, gowns, and face shields?

I guess only sheep and cowards use seat belts when driving and, really, who cares when food has reached its expiration date? It’s only a number, right?

Have I ever mentioned my belief Trump supporters are some of the dumbest idiots to ever “walk” this planet? For them, everything is politicized and science has no place in their understanding of how the world works. I’d pity them, but it seems they’re bound and determined to drag us down with them. Let’s not comply. Wear your mask in public. Let’s mitigate and bring this beast under control, which we may have to do without the assistance or coordination we might ordinarily expect from the Feds, seeing as how we have an incompetent boob at the top.

I’m not real big on nostalgia but . . . given the enormity of the shit show we’ve been enduring these past three and a half years, I found watching this enormously satisfying and entertaining. I recommend it highly. You’re welcome.

Weird how a lying grifter deeply beholden to Russian oligarchs and their mafia, a serial rapist and abuser who’s been married three times and cheated on each of his wives, a traitor who is busy dismantling the government (not that it couldn’t use an overhaul) and selling it piecemeal to the highest bidder, a selfish, egotistical, narcissistic imbecile who trashes the Constitution he doesn’t understand or care about on a daily basis . . .

. . . can make you nostalgic for Dubya.


How NOT to Lead!

As long as Trump is president, we will never—repeat, NEVER—deal with this pandemic intelligently. He is a micro-manager, which means he will not allow anyone other than himself to control how this virus is dealt with. Consequently, since he is an ignoramus who thinks he knows absolutely everything (“I, alone, can fix it.”) there’s no aspect of this battle that will be addressed with the knowledge and understanding (forget wisdom) needed to limit the damage Covid-19 will cause in the coming years.

I feel the need to repeat myself. As long as this highly unqualified, prime example of the Dunning-Kruger effect, is president of the United States, this pandemic will NOT be dealt with with any semblance of scientific rigor . . . at least not if the results contradict his painfully limited understanding of just about everything other than how to properly grift and enrich himself and his cronies.

Remember when he said “And again, when you have 15 people, and the 15 within a couple of days is going to be down to close to zero, that’s a pretty good job we’ve done.” How does one pre-emptively declare victory? It’s one thing to suggest how things might go, but to declare how those very things went before they actually “went” is the height of folly or, better yet, the mark of a snake oil salesman.

As long as this man is POTUS, we’re well and truly fucked. This country is already a shell of its former self. He’s going to wreak a whole lot more havoc in the next seven or eight months (at least) and, if re-elected, we can probably kiss our nation good bye. I, for one, will be working diligently to support California’s exit. I don’t want to live in Gilead.

As I’ve noted before, I’m continuously improving my Photoshop skills, learning how tools I’ve not used before can improve my efforts, as well as improving on techniques I’ve learned as I’ve attempted to create the visions I imagine.
